Yes—eligible adults aged 18+ may use appropriately authorised gambling services in Spain. Statutory exclusions, game-specific requirements and operator conditions still apply. Age is necessary but is not the only eligibility requirement: authorisation does not mean unrestricted access or make gambling safe.

**Reviewed on 12 October 2026.** This guide explains how to check authorisation, documents, tax rules and safer gambling controls. The registry example reflects that review date, not the future status of a website.

## Which types of gambling are legal, and who regulates them?

Gambling services need the appropriate authorisation for their jurisdiction. DGOJ, Spain’s gambling regulator for state-scope activities, oversees national online offerings. Physical venues and purely regional offerings are subject to the rules of the relevant autonomous community.

[Law 13/2011, Articles 1–2, 6 and 9–11](https://www.boe.es/buscar/act.php?id=BOE-A-2011-9280), establishes the state-scope framework, authorisation requirements and participation prohibitions. It does not make DGOJ responsible for licensing every physical casino in Spain.

| Type of gambling | What to check |
|---|---|
| Online casino and slots | For a state-scope offering, check the operator, exact domain and relevant game authorisation in the DGOJ registry. |
| Online poker | Check the poker authorisation, not merely whether the operator appears in the directory. Purely regional offerings follow the applicable regional rules. |
| Online sports betting | Check the authorisation for the relevant betting activity and the exact domain. A licence for another game is not a substitute. |
| Physical casinos, bingo halls, betting shops and gambling machines | Check authorisations and admission rules under the autonomous community where the venue is located. |
| Lotteries reserved by law | Check the special legal regime and authorised organiser. These are not equivalent to ordinary online casino licences. |

A general licence covers a category of activity; a singular licence authorises a specific game within it. An operator’s presence in the registry therefore does not establish permission to offer every game.

A foreign licence does not substitute for Spanish authorisation. A `.es` domain suffix or a copied Juego Seguro logo alone proves nothing: verify the official record.

## How do you check an operator and its exact domain?

Check the legal entity, domain and authorisation for the intended game together. The reproducible example below uses the brand 888; it is a dated registry example, not an operator recommendation, payout guarantee or live wager test.

### 1. Search for the operator by brand

Open the [official DGOJ operator directory](https://www.ordenacionjuego.es/operadores-juego/operadores-licencia/operadores). Enter `888` in **“Nombre del operador o website”**. Leave **“Licencias”** at its default setting, then press **“Buscar”**.

The observed results showed one company associated with `888.es`, `888sport.es`, `888casino.es` and `888poker.es`. Match the domain you intend to use exactly against the record, rather than relying on a similar brand name.

![DGOJ directory search for 888 showing the company and its associated domains](https://toolsgambling.vei96rus.workers.dev/media/article/2026/10/8344b3e485eef7403e6075d6b9fa2b10.webp)

*DGOJ operator directory search. The screenshot retains the original Spanish interface labels.*

Our observed search for the exact domain `888casino.es` returned no results. An empty result alone is not proof that a site is illegal. Retry using the brand or legal entity, then compare the domains in the resulting record.

### 2. Check the authorisation for the specific activity

Open the [legal entity’s registry record](https://www.ordenacionjuego.es/operadores-juego/operadores-licencia/operadores/888-online-games-espana-sa). It shows the general categories **“Apuestas”** and **“Otros juegos”**, meaning betting and other games. It also lists singular licences for poker, slots, blackjack, sports betting and roulette.

*DGOJ licence record. Category and game names appear in their original Spanish.*

Check the relevant activity and current dated decisions in the record. There is no “Active” column in this walkthrough: base your conclusion on the information the registry actually provides.

Do not assume that a foreign `.com` website belonging to the same brand inherits the `.es` site’s authorisation. If the identity, domain or authorisation remains unclear, ask the regulator and do not deposit until it is clarified.

## Can a tourist visit a casino or open an online account?

Tourists must check physical venue admission and online account eligibility separately. Being allowed into a casino does not mean being eligible to register with every online operator.

[Casino Barcelona’s official FAQ](https://www.casinobarcelona.com/en/frequently-asked-questions) requires EU visitors to present an original identity document or passport, and non-EU visitors to present an original passport. This is a venue-specific example. Other venues have their own admission and dress rules.

For online accounts, the [identification resolution, including Annex sections 5.3, 8 and 11](https://www.boe.es/buscar/act.php?id=BOE-A-2012-9658), allows documentary identity verification of nonresidents without DNI/NIE—the Spanish national identity document or foreigner identification number. It does not oblige every brand to accept every tourist.

Before depositing, ask support whether your actual location and country of residence are permitted. Confirm which identity documents are accepted and what address and payment requirements apply. Keep the support response.

There is no universal requirement for a Spanish bank account or NIE in every such case. Equally, there is no promise of immediate account access or withdrawal before identity verification is complete. Do not evade location restrictions or use someone else’s identity documents.

## Which gambling taxes might apply?

Tax treatment depends on tax status and the type of prize, not simply citizenship or withdrawal amounts. Ordinary gambling by Spanish tax residents, qualifying lottery prizes and nonresident winnings need separate treatment.

| Situation | Main treatment | What not to assume |
|---|---|---|
| Ordinary gambling by a Spanish tax resident | Documented gains and eligible losses in the same tax period are considered under IRPF, Spain’s personal income tax. A positive result enters the general IRPF tax base. | That withdrawals equal taxable income, or that everyone pays one fixed rate. |
| Certain lottery prizes qualifying for the special regime | A qualifying prize has a €40,000 exemption and a 20% tax on the excess. | That this treatment applies to every casino win or every lottery worldwide. |
| Nonresident winnings | Tax status, income type and any applicable international treaty require separate review. | That every tourist pays a universal 19% or 24% rate. |

### Ordinary gambling: use annual results, not withdrawals

For a Spanish tax resident, eligible documented gambling losses can offset gambling gains from the same tax period, but only up to the amount of those gains. See [Article 33.5.d of the IRPF law](https://www.boe.es/buscar/act.php?id=BOE-A-2006-20764#a33) and the [AEAT tax authority’s guidance](https://sede.agenciatributaria.gob.es/Sede/ayuda/manuales-videos-folletos/manuales-ayuda-presentacion/irpf-2025/7-cumplimentacion-irpf/7_6-ganancias-perdidas-patrimoniales/7_6_6-cumplimentacion/7_6_6_1-apartado-f1/premios-sin-fines-publicitarios.html).

In a hypothetical example, gains of €6,000 and eligible losses of €4,500 leave a positive difference of €1,500. This is an amount to account for in the tax base, **not the final tax bill**. The example assumes documented, eligible amounts from one tax period; the whole-euro figures require no rounding, and no personal tax liability is calculated.

If gains are €3,000 and losses are €4,500, at most €3,000 of losses can be offset. The remaining €1,500 cannot be deducted from salary. Actual liability depends on other income, region and personal circumstances.

Deposits, withdrawals and returned stakes are not themselves taxable winnings. Keep activity statements and records across all relevant operators for the tax period. Bank receipts or withdrawal totals alone are insufficient.

The linked AEAT guide is for the 2025 return and was published in 2026. It is not a universal calculator for personal tax liability in 2026.

### Lottery prizes: the special regime has limited scope

For one qualifying SELAE ticket with a €100,000 prize, €40,000 is exempt. The withholding is 20% of €60,000, or €12,000, leaving €88,000. SELAE is Spain’s state lottery and betting organiser; see its [prize taxation guidance](https://www.loteriasyapuestas.es/es/paginas-informativas/ayudas/cobro-de-premios/como-tributan-los-premios-de-selae-2) and the [AEAT explanation](https://sede.agenciatributaria.gob.es/Sede/todas-noticias/2024/diciembre/17/premios-sorteo-loteria-navidad.html).

This example assumes one ticket qualifying for the special regime. Its whole-euro figures require no rounding. For a shared ticket, the exemption is divided proportionally among the holders: each holder does not receive a separate €40,000 exemption against the same prize.

### Nonresidents: establish tax status first

Nonresidents should not apply ordinary resident gambling rules automatically or assume a fixed tourist tax rate. Ask AEAT or a tax adviser to review your country of tax residence, the type of winnings and any applicable treaty. Citizenship does not replace that assessment.

## Which deposit limits apply on the review date?

On 12 October 2026, the baseline deposit limits per operator are €600 per day, €1,500 per week and €3,000 per calendar month. The complementary aggregate system with different amounts is not yet applicable.

| System | Daily | Weekly | Longer period | Applicability |
|---|---:|---:|---:|---|
| Current per-operator baseline | €600 | €1,500 per week | €3,000 per calendar month | On the review date |
| Complementary aggregate system | €700 | €1,750 per week | €3,300 per four weeks | From 25 March 2027 |

The current rules appear on the [DGOJ deposit limits page](https://www.ordenacionjuego.es/participantes-juego/juego-seguro/limites-deposito) and in [Article 36 and Annex II of the existing decree](https://www.boe.es/buscar/act.php?id=BOE-A-2011-17836). The future system is set out in [Royal Decree 520/2026, Final Provision 2 and Annex III](https://www.boe.es/eli/es/rd/2026/06/24/520), adopted in June 2026. DGOJ explicitly states its applicability date.

![DGOJ page fragment stating that aggregate deposit limits apply from 25 March 2027](https://toolsgambling.vei96rus.workers.dev/media/article/2026/10/90fdca39a953bcec93c269d0266a1c32.webp)

*Official DGOJ fragment showing the future system’s applicability date. The text remains in the original Spanish.*

A calendar month and four weeks are different periods. Personal decreases and controlled changes to limits are available, so the listed amounts are not an immutable universal ceiling for every situation.

A deposit limit restricts money paid into a gambling account. A loss limit restricts a different measure, while a spending budget is the amount you allocate to gambling. Statutory limits do not establish what you can afford. For separate budget planning, see the [bankroll management guide](https://toolsgambling.com/blog/bankroll-management-guide): a bankroll is a dedicated play budget, not a guarantee of an acceptable level of loss. Do not use multiple accounts to bypass limits.

## How does operator self-exclusion differ from RGIAJ?

Self-exclusion with one operator applies within that operator’s procedure, while RGIAJ registration has a broader statutory scope. RGIAJ is Spain’s register of people prohibited from accessing gambling.

The [official RGIAJ registration and rules page](https://www.ordenacionjuego.es/participantes-juego/juego-seguro/rgiaj) explains its coverage of regulated state-scope online gambling. Coverage of physical gambling where participants are identified depends on autonomous-community rules. It is not a promise to block every offshore site or every physical gambling activity.

Registration is indefinite. You may request cancellation after six months, but registration does not expire automatically at that point. The official page offers electronic registration with a digital certificate and signed paper submission channels; check that page for the available application routes.

Deleting an app is not self-exclusion and does not enrol you in RGIAJ. To restrict participation, use the relevant official procedure rather than only removing the app.

## What should you do about a suspicious site or a dispute?

If a site raises doubts, verify its authorisation and domain before depositing. For a dispute with a licensed state-scope operator, complain to the operator first. An unusual payment method or a foreign licence alone is not enough to determine whether a particular offering is lawful or fraudulent.

Foreign authorisation presented instead of Spanish authorisation, copied logos, mismatched domains and anonymity claims require verification. If you cannot establish the site’s connection to an official record, do not deposit.

For a complaint, save the request reference or submission confirmation, activity and transaction records, screenshots and the operator’s response. If you are dissatisfied with the response, or receive no reply within one month, you can escalate through the [official DGOJ complaints procedure](https://www.ordenacionjuego.es/denuncias-reclamaciones). Include proof of the first complaint and the response, if received.

This procedure concerns licensed state-scope operators. It does not guarantee reimbursement or provide a universal way to recover money from unlicensed offshore sites. Physical venue disputes follow regional procedures.

## What should you check before playing?

Before playing, confirm eligibility, authorisation for the intended activity and your ability to complete identity verification. Then set personal controls and arrange to retain your records.

- You are aged 18+ and are not subject to a participation prohibition.
- The operator and intended game have the appropriate authorisation.
- The exact domain matches the official record, not merely the brand name.
- The conditions permit your location and country of residence; accepted documents, address and payment requirements are confirmed before depositing.
- You distinguish deposit limits, loss limits and your own budget, and understand the self-exclusion process.
- You retain gambling activity records, payment records and correspondence for tax reporting and possible complaints.

If any point remains unclear, obtain confirmation from the operator or competent authority first. Do not test eligibility by depositing money.

## FAQ

### Does Spanish citizenship or opening a gambling account make me a Spanish tax resident?

No. Citizenship, eligibility for a gambling account and tax residency are separate matters. Your tax status needs a separate assessment of your circumstances and any applicable international tax treaty.

### Can I work out taxable gambling income from withdrawals alone?

No. A withdrawal is not the same as taxable income. For ordinary gambling by a Spanish tax resident, retain documented results for the relevant tax period across all operators where you played.
